It is perfectly legal for a restaurant to serve only Kosher food, just as it is perfectly legal for a restaurant to serve only non-Kosher food - in other words to cater to a certain segment of the population. Why shouldn't it be legal for a restaurant to cater to smokers? Think about it - a person who keeps a Kosher home is not going to work in a non-Kosher restaurant. Why is that no different than a person who wishes to remain smoke free finding a job in a non-smoking restaurant?

Gibson recommended that Chicago's ban be repealed to end the court fight with the billboard industry here and save "several million dollars" in legal fees that the city might have to pay if the case were pressed. The full City Council is expected to follow the Buildings Committee's recommendation Oct. 31.
